If your employer hasn't paid your wages, entitlements or superannuation in Australia, you have options — from raising it directly, to the Fair Work Ombudsman, to a claim to recover what you're owed. Underpayment claims can usually go back several years. Here's how it works.

Check what you're owed

Work out your correct pay under the relevant award, agreement or contract, including overtime, leave and super. Payslips and your employment records are the starting point.

The Fair Work path

You can raise it with your employer in writing, and the Fair Work Ombudsman helps employees recover unpaid wages and entitlements. Superannuation shortfalls can also be raised with the ATO.

Recovering underpayments

Underpayment claims can generally go back up to six years. Where it isn't resolved, a claim can be made to recover the money, and a lawyer can advise on the best forum.
