How does a TAC claim work in Victoria?
The Transport Accident Commission (TAC) runs Victoria's no-fault scheme for people injured in a transport accident. You can claim support for medical costs and lost income regardless of who caused the accident.
What the TAC covers
Medical and hospital treatment, ambulance, and rehabilitation, and - if your injuries stop you working - income support for lost earnings. For serious injuries it can also fund longer-term support and some travel costs.
How to lodge a claim
See a doctor, make sure the accident is reported to police where required, and lodge a TAC claim - generally within 12 months of the accident. You are given a claim number to use for your treatment and payments.
No-fault - even if it was your fault
TAC benefits are no-fault, so you can claim medical and income support even if the accident was partly or fully your fault. Fault only matters for a separate common-law claim.
When you may also have a common-law claim
If you were seriously injured and someone else was at fault, you may also have a common-law claim for a lump sum covering pain and suffering and loss of earning capacity. It needs a serious injury certificate and is separate from your TAC benefits - a lawyer usually runs it, often no-win-no-fee.
